Farmer slashed by Taib-linked men

Surik Muntai and 300 other landowners from 17 longhouses
from Melikin in Serian district are suing a company linked
to two PBB leaders for encroaching into their NCR land.
KUCHING: A director of an oil palm plantation company, linked to two leaders in Chief Minister Taib Mahmud’s Pesaka Bumiputera Bersatu has been detained for allegedly assaulting a 67-year-old farmer over a native customary rights land issue.
Serian police confirmed that Andrew Wong, a director in United Teamtrade Sdn Bhd was arrested three days ago and is currently in remand.
Wong together with three other security personal, one allegedly armed with a  parang, had attacked farmer Surik Muntai last Friday while he was waiting to pick up his son from the Sungai Menyan primary school.
He was severely wounded and suffered a broken right arm and legs in the attack. He is now recuperating in the Sarawak General Hospital, Kuching.

STAR: Don’t Play With Words, NCR is Life

“The Chief Minister need to realize that NCR and native lands are life to the natives and too precious and should not play with words to hoodwink the natives” said Datuk Dr. Jeffrey Kitingan, STAR Sabah Chief, in response to the Chief Minister’s reply in the State Legislative Assembly on Monday that the government has given priority to native rights.

The government’s ploy in using the State Attorney General and more recently the Lands and Surveys Director to state the government’s policy that NCR did not exist after 1930 has obviously backfired.  The move had incurred the wrath of the natives and reduced substantially the support of the Umno/BN government especially for the local KDM parties, PBS and Upko.

STAR: BN Government Planning to Abolish Native Rights

The native customary rights of indigenous people are recognized and are to be protected and have been universally adopted of late by many countries under the United Nations Declaration of Rights of Indigenous People.

The recent statement by the Lands and Surveys Director that NCR does not exist after the enforcement of the Sabah Land Ordinance, 1930 is not unexpected as the present government has failed to resolve NCR problems in the State.

The Director cannot be blamed for being used as the mouthpiece of the BN government and merely echoed the previous statement of the State Attorney General.

Villagers cried foul over land

KOTA KINABALU: Instead of enjoying the wealth of toiling on the soil in Kampung Serudong Laut, Tawau, the villagers there are instead faced with a dilemma after discovering that they are not the owners of the land.

What saddens the villagers most was that the land they worked so hard on to eke out a meagre living are supposed to be theirs based on Native Customary Right (NCR).

They brought their plight to the attention of Sabah Progressive Party (SAPP) Vice President cum Tawau Member of Parliament Datuk Chua Soon Bui who assured them of her assistance to get to the bottom of the matter.

Jeffrey: Land disputes leading to violence

The Sabah government is yet to fully respond to the
people’s grievances on NCR land grabs.
PINANGAH: State Reform Party (STAR) has warned that the increasing number of land disputes in Sabah is showing signs of turning ugly and may eventually lead to violence if the government continues to turn a blind eye on them.

In his speech at a land rights demonstration here recently, Sabah STAR chairman Jeffrey Kitingan expressed his disappointment that the state government has been neglecting the people despite the fact that the problem has been happening for many years.

Recently in Kota Kinabalu, Datuk Seri Anwar officiated a forum on Native Customary    Rights (NCR) issues and protection of Native Religious Rights in Sabah. Braving  extreme weather conditions late but safe, Datuk Seri Anwar managed to close the forum with an applause. As a seasoned and well versed Election Observer I attended under the auspices of our humble NGO to hear and to see the amount of interest the forum captured. Datuk Seri tactfully delivered key notes on religion and the protection of the religious rights of the Native Christians in Sabah, an issue that until today Peninsular Politicians will not and can not fathom its uniqueness that Bumiputras in Sabah are Christians. These native rights as enshrined under the 20 point Sabah Constitution that are being silently and quickly eroded. To the thumping rounds of cheers in support of  Datuk Seri Anwar’s undertaking that the state’s unique constitution will be protected and reinstated has sparked immense hope especially from the Native Kadazan Dusun Murut Community (KDM) of its preservation.

Bludgeoned natives to sue police

A father and son who were attacked by gangsters are planning to sue the police for not acting on their report and for detaining them instead.
KUCHING: A native landowner and his son who were bludgeoned by gangsters on Feb 14 last year while defending their property and who were later imprisoned by police for lodging a report on the incident, are now planning to sue the authorities.
Minggat Nyakin and his son Juan were badly beaten by the gangsters when they tried to block the thugs from extracting timber from their NCR land at Sungai Rotan and Sungai Penyaru Kuba, Sarikei.
According to Minggat, the gangsters had the intention to kill both of them, but since his son had managed to escape to seek help, they had to hurriedly left him unconscious and sprawled on the ground.

Guns, threats won’t scare us, say natives

If the government continues to remain aloof from clashes
between natives and oil palm companies, then it should
be prepared for a bloodbath.
KUCHING: Despite two attempts on his life by workers allegedly from Palm Raya Pelita, Semawi Anak Renang will not be intimidated in defending his native customary rights (NCR) land and that of 25 other families.

Instead the threats against him and the other landowners of Rumah Randi, Selangau, have made them more determined than ever to defend their 3,000 hectares of land.

The landowners claimed that the Palm Raya Pelita oil palm plantation is owned by Tiong King Sing, the MP for Bintulu. Tiong is also the deputy president of Sarawak Progressive Democratic Party (SPDP) and one Peter Hii.

S'wak can’t step outside bounds on ties with Putrajaya

Malaysia Agreement or no Malaysia Agreement, Sarawak or Sabah/Labuan for that matter, cannot step outside the bounds with the Federal Government. Putrajaya belongs as much to the two Malaysian states in Borneo as to Peninsular Malaysia.

At a lower level, the Federal Government presides over the individual sultanates, states and territories in Peninsular Malaysia.

Five on-going issues, some simmering for long, have pitted the Sarawak state government in a head-long clash against the Federal Government. It’s anybody's guess how Putrajaya will bring the recalcitrant Taib Mahmud regime to heel. Surely, the Joseph Pairin Kitingan administration (1985 - 1994) in Sabah is the mother of all precedents!

Perjanjian Malaysia Dan 20 Perkara Masih Relevan Disabah

Beliau berkata, kenyataan Datuk Salleh itu amat mengecewakan segenap lapisan rakyat kerana sikapnya yang tidak patriotik untuk mempertahankan hak asasi rakyat negeri ini malah sanggup memperlekehkan perjanjian 20 perkara sebagai tidak wujud lagi.

Negara Brunei dan Singapura yang kini jauh lebih maju dan pesat membangun malah memiliki ekonomi yang jauh lebih baik berbanding Sabah selepas mereka tidak meneruskan untuk bersama dalam pembentukkan Malaysia pada ketika itu (Singapura keluar dari Malaysia tahun 1965).

KOTA KINABALU, April 4, 2012: The purpose of this Press Conference is to announce the LAND AND NCR REFORMS MASTERPLAN of STAR Sabah and the relevant portion of the STATE ADMINISTRATION REFORMS related to land administration which forms part of the Land and NCR Masterplan.

“Under its Land and NCR Reforms Masterplan, STAR will respect and restore the rights of natives to NCR and native lands and prioritize land for all Sabahans based on its policy and vision “NCR FIRST, SABAH LAND FOR SABAHANS FIRST”.

Pairin's silence on NCR is moral abhorance to KDMs

KOTA KINABALU : In respond to Johnny Mositun's statement over the above issue, i would say that Joseph Pairin Kitingan just cannot hide behind the cultural nature of KDCA and use this as an excuse to remain mute in the wake of the onslaught on KDM's native customary lands.

Pairin cannot completely detach himself from this issue given his position as the Deputy Chief Minister of the very government which bent on destroying the NCR of the KDMs whose native ethnic he himself belong to.

Pairin cannot turn a blind eye on the fact that being a President of KDCA he has a moral duty to protect and safeguard the rights of his people from being unjustly treated in their very own land.

Beliau berkata, rakyat cukup menderita jika keadaan sebegini berterusan apabila hak rakyat yang miskin terus tertindas dimana tanah tanah dirampas, rumah dirobohkan oleh syarikat syarikat gergasi dari luar Sabah, malangnya pihak berkuasa khususnya PDRM tidak berbuat apa apa.

KDCA slammed for failing to respond to State AG's attack on NCR land

KOTA KINABALU : The Kadazandusun Cultural Association (KDCA) being the custodian of the KDM's rights which include their native lands and the KDM's are all natives, KDCA should be in the forefront in defending these rights. But alas, KDCA is silent.

This could be construed to mean that KDCA and its president Joseph Pairin Kitingan, who is the Huguan Siou of the KDMs, are condoning this barbaric land grabs of the KDM's native customary lands, now this devilish pronouncment of non-existence of NCR lands after 1930 by the highest legal mind of the Government of which Pairin is a party.

Komuniti Orang Asal Sabah gasak Peguam Besar Negeri Sabah fasal NCR

KOTA KINABALU: Penduduk Orang Asal di Sabah hari ini meluahkan perasaan marah dengan kenyataan kontroversial yang dibuat oleh Peguam Besar Negeri Sabah, Roderic Fernandez, sekaligus bertindak menggesa agar beliau meletak jawatan.

Seramai hampir 30 orang wakil penduduk daripada semua daerah termasuk dari pantai timur negeri sebulat suara membuat gesaan tersebut dalam satu perjumpaan di Penampang Selasa lalu berikutan kenyataan yang dibuat oleh Fernandez baru-baru ini yang dipetik sebagai berkata bahawa Tanah Hak Adat Orang Asal atau Native Customary Right (NCR) tidak wujud selepas tahun 1930.

Suruhanjaya Hak Asasi Manusia Malaysia (Suruhanjaya) memandang berat dan bimbang dengan kenyataan terkini yang dilaporkan dibuat oleh Peguam Negeri Sabah bahawa Ordinan Tanah Sabah (OTS) yang berkuatkuasa pada tahun 1930 tidak membenarkan wujudnya Hak Tanah Adat yang baru di Sabah. Menurut Peguam Negeri Sabah tidak ada peruntukan dalam OTS bagi anak negeri untuk membuat penempatan selepas 1930 dan menuntut Hak Tanah Adat, yang mana ianya jelas bercanggah dengan kedudukan Hak Tanah Adat yang merupakan hak asas masyarakat Orang Asal/Asli sepertimana dijamin dalam Perlembagaan Persekutuan.

Native Customary Rights To Land Are Guaranteed Under The Constitution

The Human Rights Commission of Malaysia (the Commission) views with great concern and disquiet over the recent statements reportedly made by the Sabah Attorney-General that the Sabah Land Ordinance (SLO) that came into force in 1930 does not allow for the creation of fresh Native Customary Rights (NCR) to land in Sabah. According to the Sabah Attorney-General, there is no provision in the SLO for natives to go into occupation of land after 1930 and claiming NCR on it, which clearly contradicts the position that NCR to land is a fundamental right of indigenous communities guaranteed under our Federal Constitution.

Kuamut surrendered bundles of NCR evidences to STAR

LUYANG: The Kuamut State Reform Party (STAR) committee recently handed over to state STAR bundles of evidences of Native Customary Rights (NCR) lands of the Tambanuo community within Kuamut and Sukau constituencies in Kinabatangan area.

A local Tambanuo leader, James Ait, who is also STAR Sabah chapter state committee member presented the documents to STAR Sabah chapter chairman, Datuk Dr Jeffrey Kitingan at his office in Damai, Luyang.
